SECTION 1: WHAT THE AR DECISION WILL MEAN

Administrative Review asks one question. Did the caseworker who refused your Innovator Upgrade or Innovator Extension visa application make a specific, identifiable error? If yes, the decision is overturned. If no, your refusal stands.

Your solicitor has filed the AR submission. That submission (all 5,000 characters of it) is all the reviewer will consider. Any supplementary letter sent to UKVI after that submission was filed cannot be considered. Published caseworker guidance requires the reviewer to disregard it. The submission is the entire AR.

Whether that submission correctly identified the caseworking errors in your refusal, we cannot say without seeing it. What we can say is this.

The most significant error in many Innovator extension refusals is one that most solicitors do not identify. We endorsed your business. We confirmed, on official Home Office forms, that your business was active, trading, and sustainable, and that you had made significant achievements against your business plan. The caseworker then refused you on those same grounds.

Published Home Office caseworker guidance states that caseworkers "are not expected to duplicate" the endorsing body's assessment. Where a caseworker refuses on grounds that The Startup Race has already assessed and confirmed, they may be failing to apply that published guidance. That is a specific, arguable ground for Administrative Review.

If your solicitor did not argue this in the 5,000-character submission, that ground has not been raised. The AR will be decided without it.

We are not telling you this to criticise your solicitor. We are telling you because it changes what you should do with the time that remains.

If your Administrative Review appeal is refused, you need a new endorsement letter ready for the day the decision arrives. If the AR succeeds, the letter strengthens your position going forward. If it fails, (which, on the evidence of most submissions, is more likely than not) the letter is the only thing that keeps you and your family in the UK.

SECTION 2: WHAT WE KNOW ABOUT YOUR CASE — AND WHY IT MATTERS

When you applied for your Innovator Extension or Innovator Upgrade, we assessed your business. We conducted your contact point meetings. We confirmed the criteria on the endorsement letter We wrote for you.

We know which parts of your business were strong at assessment. We know which parts were marginal. We know what the caseworker found in your application that led to the refusal. And We know exactly what needs to change in the evidence before We can write a stronger letter.

No immigration solicitor has this knowledge.

No other endorsing body has this knowledge. A solicitor reads the refusal letter. I read the refusal letter against the assessment we conducted — and we can see the specific gap between what the evidence showed and what the criteria required.

That is the starting point for this programme. Not a general review of your business. A precise, criterion-by-criterion assessment of what changed between your last endorsement and your refusal — and what needs to be corrected before a new letter can be written.

If your refusal rests on a caseworker finding that contradicts what We confirmed in your endorsement letter, We can provide a statement from The Startup Race setting out what We assessed and what We confirmed. Whether that statement can be used in the AR, in a pre-action protocol letter, or in a fresh application is a question for your solicitor. But the statement itself can only come from me.

SECTION 3: WHAT THE PROGRAMME DOES

The programme works through the specific reasons for your refusal. It does this criterion by criterion, session by session.

At the first session, we read your refusal letter against our own endorsement assessment. We identify precisely what changed between endorsement and refusal. We identify what the evidence currently demonstrates and what it still needs to demonstrate. We confirm whether there are structural issues — changes to the business since endorsement — that need to be resolved before a new letter can be written.

In subsequent sessions, you build the evidence. We assess it. We identify what it demonstrates and what it does not yet demonstrate. You address the gaps. Nothing moves forward until the evidence meets the standard.

When the evidence is sufficient, we write a new endorsement letter for you. For most founders in this programme, that letter will be either an Innovator Extension endorsement or an Innovator Upgrade endorsement, depending on your route. Both confirm the same business. Both are issued by The Startup Race as your legacy endorsing body.

The programme runs over six months. The AR may resolve before it completes. If it resolves while you are mid-programme, the letter may not yet be ready — but the preparation completed to that point is not lost. We assess your position and continue.

The goal is to have the letter ready before the AR resolves. That is the only situation in which you have a clear path on the day the decision arrives.

SECTION 4: WHAT THE LETTER ENABLES

Published Home Office caseworker guidance confirms that a The Startup Race endorsement letter is accepted for a fresh Innovator Founder visa application — provided The Startup Race was the endorsing body for your previous permission. The Startup Race endorsed you. The letter will be accepted.

This means that when the AR refusal arrives, you can file a fresh visa application on the same day.

You do not need to wait for a new endorsing body to assess your business. You do not need eight weeks for an assessment process to complete. You file immediately. Section 3C leave (and your right to remain) continues while that application is considered.

There are two ways to use the letter.

The first is to use it directly for the fresh application. The Startup Race issues the letter. You take it to your solicitor. Your solicitor advises you on when and whether to file. If the conditions are right, you file.

The second is to use it as the foundation for approaching UK Endorsing Services or Envestors — the two active endorsing bodies appropriate for your situation. Of the four active endorsing bodies, two are not appropriate for founders in your position. UK Endorsing Services and Envestors are the right bodies for same-business Innovator Founder endorsement. But you should not approach them with the same business that just produced a refusal.

This programme addresses the failure reasons first. The The Startup Race letter confirms that the work has been done. You approach them from a position of strength, not as a founder recovering from a refusal.

SECTION 5: THE PROGRAMME STRUCTURE

Sessions 1–2: Diagnostic assessment

We read your refusal letter against our original endorsement assessment. We identify what changed and what must be corrected. We assess the current state of the business against each criterion. We confirm whether any structural changes (post-endorsement equity changes, parallel trading companies, undocumented model changes) need to be resolved before the letter can be written. You leave with a written session plan: what needs to be built, in what order.

Sessions 3–8: Evidence building

Each session has a defined focus. A specific refusal finding. A specific criterion. A specific element of the business that the evidence does not yet adequately demonstrate. We review what you have built since the previous session. We assess what it demonstrates and what it still does not. You address the gaps. We assess the result. We do not move to the next session until the current criterion is met.

Every strategic decision made during these sessions (every agreed direction for the business) is documented in writing at the time it is made. That documentation is an evidential record of approved business development decisions. It is relevant to both the endorsement assessment and to any AR argument that the business model evolved in a direction The Startup Race reviewed and approved.

Sessions 9–10: Pre-endorsement assessment

We assess the full evidence base against the endorsement criteria. We confirm what is sufficient and what is not. If gaps remain, we state them specifically. We do not write a letter we cannot defend.

Sessions 11–12: Letter drafting and filing plan

We draft the endorsement letter. We review it together. We issue it when you confirm it is accurate. We plan the filing timeline (letter issue date, three-month validity window, UKVI processing time, solicitor review) so that no time is lost between the letter being issued and the application being filed.

You were endorsed by The Startup Race for an Innovator Founder visa extension or upgrade. Your application was refused. Your Administrative Review has been filed and the decision is still pending. You are in the UK. Section 3C leave is active.

This programme is not for you if:

Your AR decision has already arrived. If the AR has been rejected, Section 3C leave has ended. Your immigration position is urgent in a different way. Your first call is to an immigration solicitor — not to me. Take that advice first. Then contact me. I can confirm what the programme can offer once your status position is clear.

You were endorsed by a body other than The Startup Race. The insider knowledge that makes this programme specific to your case comes from having conducted your original assessment. I cannot apply that knowledge to another body's decisions. UK Endorsing Services and Envestors can assess your business for fresh endorsement directly.

You are building a completely new business. This programme addresses the same business that was refused. It corrects the reasons for the refusal and confirms the same business meets the endorsement criteria. Will UKVI accept a new endorsement letter from The Startup Race?

Yes. Published Home Office caseworker guidance confirms that a legacy endorsing body endorsement letter is accepted for a fresh application under the same-business criteria, provided the legacy endorsing body is the same as the endorsing body for the previous permission. The Startup Race endorsed your previous application. The letter will be accepted.

Can the new endorsement letter be used as evidence in the AR?

No. Administrative Review cannot consider new evidence in the circumstances that apply to a standard Innovator extension refusal. The letter is not AR evidence. Its purpose is to be ready when the AR decision arrives, not to influence the AR.

My solicitor sent a cover letter and supporting bundle to UKVI after the AR was filed. Will that be considered?

No. Published caseworker guidance requires the reviewer to disregard any evidence that was not before the original decision maker. The 5,000-character online submission that was filed is the entire AR. Supplementary material sent afterwards cannot be considered by the reviewer.

The AR could resolve in a few weeks. Is there enough time to complete the programme?

Possibly not, and that is the reason to start immediately. If the AR resolves before the programme completes, the preparation done to that point is the preparation available to you. A partial programme that produces a strong foundation for the fresh application is better than no preparation at all. The earlier we start, the more is complete when the decision arrives.

What happens if the AR is granted before the programme completes?

The programme pauses. If the AR succeeds, your original extension is restored. We assess your position together and decide whether to continue, pause, or close the programme. Work completed to that point is charged at a pro-rata rate. Unused sessions are refunded. This is confirmed in the programme agreement before we start.

What is the difference between an Innovator Extension and an Innovator Upgrade endorsement?

An Innovator Extension is for founders whose previous leave was granted as an Innovator and who are applying to extend on the same business. An Innovator Upgrade is for founders who entered on an earlier Startup route and are applying to move to the current Innovator Founder route, continuing the same business. I will confirm which applies to your situation at the first session.

Do I need an immigration solicitor as well as this programme?

For the programme itself, no. For using the endorsement letter to file a fresh visa application, yes. Your solicitor advises you on when and whether to file, what your status position is at that point, and what protective steps are available. We will direct you to that conversation clearly when the letter is ready.
